ISRAEL: Compliance with ISPM 15 standard for fumigation of wood packaging materials will begin on 1st October 2009


REMINDER



On October 1, 2009 Israel implements the international standards criterion for importing and exporting wood packaging, known as ISPM 15. This rule states that on October 1, 2009 all regulated Wood Packaging Material (WPM) entering Israel must be appropriately treated and marked under the official program.
With this, Israel joins an extensive and emerging list of 65 countries, requiring adherence to the ISPM 15 Standards.

Compliance with ISPM 15 allows for two wood treatment options:



·Methyl Bromide (MB) Fumigation or Heat Treatment. With the MB treatment, the wood packaging material is fumigated with methyl bromide.

·Heat Treatment (HT) of wood packaging material must be heated in a schedule that achieves a minimum core temperature of 56ºC for a minimum of 30 minutes.

Israel's official gazette published the rule on 25th March 2009 and announced it will be enforced as from 1ST OCTOBER 2009.

As from this day all imported Wood packaging material, see below, must be subject to ISPM 15.

Wood packaging material must be subject to either a heat treatment or fumigation as per ISPM 15.

· Wood packaging material: in the form of packing cases, boxes, crates, drums and similar packings, pallets, box pallets and other load boards, pallet collars, actually in use in the transport of objects of all kinds, except raw wood of 6 mm thickness or less, and processed wood produced by glue, heat and pressure, or a combination thereof.

· Wood used to wedge or support non-wood cargo, including that which has not kept its natural round surface, except raw wood of 6 mm thickness or less and processed wood produced by glue, heat and pressure, or a combination thereof.

- Under the regulations, foreign exporters must use wood packaging certified by an authorized agency.

- To certify treatment, the WPM must be marked with the International Plant Protection Convention (IPPC) logo. Paper certificates of treatment will no longer be required or accepted.

Timber packing and dunnage bearing the mark below is certified as having been subjected to an ISPM 15 approved treatment.

An ISPM 15 compliant mark must include:

*IPPC certification symbol.

· XX: represents the two letter ISO country code (e.g. IL for Israel, AU for Australia, US for United States, NZ for New Zealand, GB for United Kingdom).

· 000: represents the unique certification number issued by AQIS to the treatment provider or wood packaging manufacturer. Inclusion of this certification number ensures that the wood packaging material can be traced back to the treatment provider and/or manufacturer.

· YY: is the treatment abbreviation where:
- HT is the code for heat treatment to a minimum of 56o C for a minimum of 30 minutes
- MB is the code for methyl bromide fumigation.

The letters 'DB' represent debarking. DB may be added to the abbreviation of the ISPM 15 approved treatment. For example, 'HT DB' represents heat treatment and debarking and 'MB DB' represents methyl bromide fumigation and debarking.

Note

WPM that does not meet these requirements will be delayed at the port of entry.

Importers whose consignments does not meet these requirements will have the option to have the shipment re-exported.

Shipments containing WPM that violate the rule may be allowed entry only if the Israeli Customs Authority or The Plant Protection and Inspection Services (PPIS) (www.ppis.moag.gov.il/ppis) determines that it is possible to separate the approved material from the noncompliant portion of the shipment.

Arrangements to have the noncompliant WPM exported from Israel or treated would be required before the approved cargo can be released to the consignee.

All costs associated with this process are the responsibility of the importer.

INDONESIA - ISPM 15 REGULATION ON WOOD PACKAGING

Treated solid wood is to be marked accordingly. In addition it is recommended that shippers provide a signed FCL/LCL Packing Declaration (see attached page 2). This applies to both Sea and Air freight.

INDONESIA - ISPM 15 REGULATION ON WOOD PACKAGING
The Indonesian Ministry of Agriculture has issued decree No.12/Permentan/OT.140/2/2009
concerning requirements of plant quarantine action on imported wood packaging material
into the Republic of Indonesia. This regulation will be implemented effective from
1st September, 2009.
The objective of the regulation is to prevent the entry and spread of quarantine pests
associated with imported wood packaging material into Indonesian Territory. The
regulation applies to all unprocessed solid wood packaging material such as dunnage,
pallets, crates, boxes, with a thickness of more than 6 mm.
All Wood Packaging Materials imported into Indonesia as mentioned above are subject to
plant quarantine action and must meet the following requirements.

AUSTRALIA - EPBS CUSTOMS NOTICE

AUSTRALIAN CUSTOMS NOTICE NO. 2009/25

Enhanced Project By-law Scheme (Item 71 of Schedule 4) – eligibility and compliance

Before claiming concessional entry under an item of Schedule 4 to the Customs Tariff Act 1995, importers and customs brokers must make certain that all goods are eligible. For Enhanced Project By-law Scheme (EPBS) item 71, particular attention must be paid to ensuring that:

1. all goods satisfy the terms of item 71; and
2. the imported equipment is specified in an AusIndustry Determination granted for the relevant project.

Only then should treatment code 471, the relevant AusIndustry Determination and the access PIN be quoted on an import declaration.

Through item 71, the EPBS provides for the duty free entry of eligible capital goods for major investment projects in the following industries:

1. mining;
2. resource processing;
3. agriculture;
4. food processing;
5. food packaging;
6. manufacturing;
7. gas supply;
8. power supply; and
9. water supply.

The Minister of Innovation, Industry, Science and Research (Innovation) has policy responsibility for the EPBS, which is administered by the AusIndustry Division of the Department of Innovation. According to current EPBS guidelines, to qualify for this concession investment projects must have a total project expenditure on capital goods of $10 million or greater. Eligible goods are essentially capital equipment purchased for the project, such as:

1. Functional units - One or more pieces of machinery, equipment or their components that are integrally connected to perform a process; or
2. Procurement/equipment packages - A quantity of the same type of machinery, equipment and their components which is used across a project; or
3. Pipes, pipelines, conveyors, flexible flow lines etc used to convey gas, liquids, minerals or other things; or
4. Stainless steel materials to be directly incorporated into the goods identified above.

Only eligible goods that are not produced in Australia, or are technologically superior to those made in Australia, are eligible for a concession under the EPBS.

Goods that are ancillary to the project are not entitled to concessional treatment. This includes items such as office equipment; goods used in activities such as land preparation, road and building construction; personnel accommodation and transportation; off-site transportation and the provision of telecommunications and other general services. Consumables used in servicing and/or maintaining the capital equipment such as fuel, lubricants, adhesives, filters, protective garments, tools, ladders, paint and varnishes and the like are not considered to be components and are not covered by the EPBS. These conditions are generally reflected in the terms of AusIndustry Determinations granted for the purposes of the EPBS. There are no standing by-laws attached to Item 71.

To monitor compliance, imports may be subject to Customs and Border Protection post-clearance audits. Importers must retain all documentation relating to the imported goods for five years after the entry of the consignment.

Importers and customs brokers should review their past importations under item 71 to ensure compliance with the terms of the item and of the relevant AusIndustry Determinations.

JEBEL ALI PORT CONGESTION SOLVED

November 26, 2008

DP World, the fourth-largest container terminal operator, said on Monday operations at its port in Jebel Ali, Dubai, were back to normal after experiencing months of major congestion problems.

Importers in September complained that congestion at the port was so bad it could take almost a week just for ships to berth.

DP World, part of state-owned conglomerate Dubai World, blamed growth volumes for the congestion, which it said put pressure on ports in the region and caused vessel delays, which had a knock on effect at Jebel Ali.

DP World said around 80 percent of vessels were arriving out of their berthing windows, “with containers stacking up and taking time to clear”; and traders were also leaving containers on the terminal for much longer, putting pressure on yard capacity.

“DP World introduced a number of initiatives to relieve congestion that began at the terminal over the summer, working closely with its customers,” the company said in a statement.

Initiatives included expanding yard capacity, working with customers to manage berthing times and increasing container storage fees, the company said.

Capacity at Jebel Ali port will increase by around five million 20-foot equivalent container units (TEU) in early 2009, when total handling capacity of the port will reach 14 million TEU, it said.

CHENGDU TO START WORK ON ASIA'S LARGEST RAILWAY CONTAINER CENTRE

CHENGDU of Sichuan province will start work on the Chengdu Railway Container Centre, the largest of its kind in Asia when it's completed, at the end of April or early May, Xinhua reported.
Meanwhile, construction on the supporting Chengdu International Container Logistics Park will also begin, the report said.
The CNY2 billion (US$285.82 million) Chengdu Railway Container Centre, located in Chengdu's Qingbaijiang District, covers an area of 1.43 square kilometres, making it the largest of the 18 railway container centres planned by the Ministry of Railway nationwide, the report said.
Construction of the facility will be carried in three phases and its annual capacity will reach 2.2 million - 2.5 million TEU or 25 million tons when all three phases are completed, the report said.
While the neighbouring Chengdu International Container Logistics Park, with an area of 2.47 square kilometres and an annual capacity of two million TEU, will be one of the three largest logistics parks in Chengdu, the report said.
With the two container logistics projects, the largest "inland port" in Central and Western China that is connected with rail-sea intermodal services to different parts of the world will emerge, an official of Chengdu said.
When the "inland port" is taking shape, transportation conditions for containers will be greatly improved, the official said.
Containers from different parts of Chengdu will be transported to the railway container centre and delivered to ports including Shanghai, Guangzhou, Shenzhen, Qingdao, Lianyungang and Tainjin by express container trains, greatly shortening transportation time from Chengdu to the coastal ports, the report said.
Currently container transportation time from Chengdu to Shanghai is five to six days by rail and eight to ten days by water. When the "inland port" is completed, it will take only 48 hours to transport containers from Chengdu to Shanghai or Beijing, greatly reducing cost, the report added.

TIANJIN APPROVED TO SET UP FREE PORT-LIKE BONDED ZONE

NORTHERN China port city Tianjin has been given green light by the Chinese government to set up an integrated bonded area in the Tianjin Binhai New Area, Xinhua reported.
The integrated bonded area, where the Airbus A320 China assembly facility is located, is inside Tianjin Port Free Trade Zone's Airport Logistics Park, covering a space of 195.6 hectares.
The Tianjin Port Free Trade Zone Administrative Committee said the integrated bonded area will be one of the bonded areas in mainland that has the widest range of functions and enjoys most preferential policies.
According to the government approval letter, the integrated bonded area will have the same functions as well as the same tax and foreign exchange policies as the bonded port areas do.
A bonded port area, according to Xu Fu, a world economy and trade expert from China's Nankai University, is similar to free ports in other parts of the world.

SHANGHAI PUDONG AIRPORT NEW TERMINAL

Shanghai Pudong International Airport opened its new Terminal 2, with an 40 million passenger handling capacity that is expected to help reduce delays. The wave-shaped terminal, 546,000 sq.m. in area and split over three levels, doubles both the size and handling capacity of the old terminal. Built under Shanghai Airport Authority's USD2.8bn expansion plan, the new terminal is expecting an estimated 15 million passengers for the World Expo in 2010

HAMBURG SÜD AND MAERSK LINE TO COLLABORATE
March 19, 2008

The German shipping company Hamburg Süd and Maersk Line (Denmark) have signed a new vessel sharing agreement. Once the cartel authorities give the green light, the two lines will launch a joint weekly service between Australia/New Zealand and the North American east coast around the end of May. Twelve 2,800 teu vessels, offering a total of 530 reefer plugs, will be deployed on the loop. Each partner will contribute six ships. The new service will replace parts of Hamburg Süd's existing Trident loop between Australia/New Zealand and the North American east coast, and Maersk Line's Oceania service to the east coast of the USA.

WEIGHT LIMITATION JAPAN
February 25, 2008

Dear Customer,We would like to inform you that the temporary acceptance regarding the weight limitation of 20’ft Containers on biaxial chassis granted by Japanese authorities for truck transports will expire from 31st March 2008. In the past it was allowed to accept a Gross Weight (GW) up to 24,000kgs for 20’ft Containers on biaxial chassis.
From 1st April 2008 the GW for those transports will be limited to 20,320kgs.
In reference to the Japanese road regulations and in order to maintain our overall service quality, we are allowed to offer the usage of triaxial chassis for a GW lower than 24,000kgs and exceeding 20,320kgs availability provided.
The upcoming increasing demand for those chassis can cause inevitable delays regarding oncarriages. The weight limitations for truck transports of 40’ft Containers remain unchanged at a GW of 30,480kgs.

MAERSK LINE INTRODUCES A NEW BAF FORMULA
January 28, 2008

Maersk Line is pleased to introduce a new formula for our floating BAF (Bunker Adjustment Factor).Our aim with the new formula is to provide a simple, fair, and transparent BAF for our customers. In addition, allowing us to share and recover the extraordinary costs provided by the increasing bunker prices.
Bunker prices have tripled within the last three years and bunker costs now constitute nearly half of the total vessel costs, up from 20% ten years ago.
“Today, we only recover approximately 55% of the bunker expenses via BAF surcharges. Naturally, this poses a significant exposure to Maersk Line, and traditionally we have tried to recover this via rate increases,” says Vincent Clerc, Vice President for Pacific Services.
“With Maersk Line’s BAF formula we will create more transparency, and our customers will experience a simple and fair way of applying BAF. Amongst our customers, we see an increased understanding and acceptance of BAF as a floating mechanism, and our customers increasingly accept that we must share the extraordinary costs in a just way.”
The BAF formulaWe have built the BAF formula on principles that are common in other transportation industries like airlines and parcel services. In these industries, prices and rates reflect fluctuations in fuel prices, and customers accept this as part of doing business in an industry, which is very reliant on fuel.
The formula builds on elements such as fuel consumption, transit time, and imbalances of container flows. However, only changes in the oil price will entail changes in the BAF level. Our customers will therefore only pay the variation in cost, and although the BAF rises when fuel prices climb, they will also benefit from downward trends as the bunker price fluctuates.
Our various trades will implement the new Maersk Line BAF formula separately, beginning the first quarter of 2008. All trades will make announcements on maerskline.com/baf when they transition to the new BAF formula. We expect to complete the rollout by 1 January 2009.

THE CHINESE NEW YEAR (FEBRUARY 6-12)

Chinese New Year is fast approaching and this requires proper planning for shipments to and from China, especially TO China. The timing of shipment arrivals is especially critical.
Chinese New Year is from February 6-12 inclusive. Most offices, as the country in general, will be closed for business during this time. Please also note that typically during the few days before the official holidays, customs and all government facilities are typically a little slower than normal on processing of documents and clearances. Please also note that after the holidays, documentation, permits, and clearances take a little longer than normal due to the backlog of arrivals.
We highly recommend that all shipments to China arrive ON OR BEFORE January 30th 2008 to ensure a timely clearance and delivery prior to the holidays.

US AND CHINA AGREE CARGO OPEN SKIES
May 30, 2007

China and the US agreed last week on a doubling of passenger flights and an effective 'open skies' policy for cargo services between their two countries, in what is seen as an important step-forward for airline market into China.
The two countries agreed to abolish all restrictions on cargo services by 2011, with a partial lifting of restrictions by 2009. The two sides state that "the agreement …will provide U.S. cargo carriers with virtually unfettered access to Chinese markets by lifting all government-set limits on the number of cargo flights and cargo carriers serving the two countries by 2011. "
At present access to passenger routes by non-Chinese carriers is limited, with only 10 flights a day by US airlines flying from the US. This is set to grow to 23 flights a day by 2012.
The agreement was part of the 'Strategic Economic Dialogue' (SED), which is an on-going process of trade negotiations between the two countries.
In passenger services progress will be slow with just one flight being added a year to either Beijing, Shanghai or Guangzhou. One new US airline may also add China to its services.
However present market trends suggest that the market for cargo services is already well supplied. The Association of Asia Pacific Airlines, which includes many of the big players in the China cargo sector such as Cathay Pacific, has reported a fall in utilisation rates, with demand in April 2007 increasing by 0.7% but capacity increasing by 3.3%, leading a fall in 'load factor' of 1.7% to 66%.
With all of the main Express companies, amongst others, having major expansion plans already in place, it might be suggested that the SED agreement only confirms the existing trends for the cargo market.

KOREAN AIR CARGO EXTENDS CHINA NETWORK

Korean Air Cargo has started regular freighter services to Chengdu, China by adjusting the schedule of its existing Incheon-Delhi-Brussels-Incheon route. In addition to Incheon-Chengdu route, Korean Air Cargo will provide air cargo service on Chengdu~ Delhi route and Chengdu-Brussels route directly.
Chengdu, located in southwest China, is the capital of the Sichuan province and a sub-provincial city. Chengdu is also one of the most important economic centres as well as transportation hubs. Chengdu is home to several key industries in and Chengdu 's Hi-tech Industrial Development Zone has attracted a variety of multinationals.
In 2000, government adopted China Western Development which is a policy to boost its underdeveloped western regions. As a result, trade volume from Chengdu has been increased more than 30% annually. The main export/import items are IT, textiles, raw materials and equipments.
